Will expungement help with a misdemeanor charge?

I read your article on how to get a job as an ex-offender. My situation is a little different. The case has been dismissed and it is a misdemeanor. In the state of NC they are allowed to hold anything on your record against you. It’s called the “at-will” labor law. I have contacted programs for ex offenders and I don’t fit into most guidelines because I wasn’t actually convicted on a crime. I have filed for an expungement but due to budget cuts in NC, there is only one person in the entire state handling expungement. This means I have to wait 7-9 for everything to be cleared. I am a masters candidate so I’ve done the face to face and handed resumes, online, walk ins, on the spot interviews…and when it gets to the background check, that’s it. No call, no email, no nothing! Please help! I so need a job like yesterday! Grateful for any resources you could possibly provide.

If your case is as you say, your charge may not be the problem. Most if not all employers are concerned with convictions not charges. Your lack of call backs may be due to other factors.

As far as expungement, many people are confused as what this term means. Too many people believe that sealing or expungement of records will erase their criminal records. In most cases and in most states, what in effect means is that their convictions will be invisible to the public. They will always be visible to law enforcement, the court system and government agencies.

My suggestion is to contact your local legal aid service. There you will find attorneys who are familiar with the expungement statutes in your state. They also know of their colleagues who specialize in area. Often lawyers will offer their service for free or nearly free as a service to the community. They may even know of employers that will hire people with criminal records.
