Can I get a job with a juvenile recordQ: I got into trouble when I was a kid. I’m now in college and deciding on a career. I am want to be an Elementary Education Teacher. Although I have a juvenile record, will it stop me from becoming a teacher?

Hello Ron,

That’s a very good question. Different to what a lot of people believe, your juvenile record doesn’t go away when you become an adult. My advice to you is apply to have your record sealed by the court.

Once a case is “sealed” it can only be examined by order of the court. Sealing of a criminal record entails that a court clerk is ordered by a judge to conceal a court record of criminal proceedings from public view. Long ago court records were in reality placed in an envelope which was bonded with a wax seal. The records are not destroyed because under certain conditions, a court can order that previously sealed records be reopened. Broadly speaking, however, the effect of sealing is the court treats the information in the record as if never existed.

Even a juvenile record can be sealed through the juvenile court. Once this has been done, the infraction shall be viewed as never to have taken place. There are no exceptions to this type of sealing; offenses are treated as though they never happened. A court not only seals its records, but also orders that records bearing information about the charges held by others be sealed as well. Persons may then by rights and legally respond to any inquiries about the arrest, acquittal, conviction etc., as if they never happened. For instance, it is permissible in a employment interview or even under oath to deny a sealed conviction. Once a record has been sealed it is not gone. I will be visible to law enforcement, government agencies and the courts. In some states, juvenile records are automatically sealed.

Even though your record may be sealed, it will always be available to the court system, law enforcement or any government agency.  So, if you are applying for a job that requires any type of certification or licensing, it may still come up

I suggest getting legal assistance in applying to get your juvenile record sealed. To save money, contact your local legal aid office. There you will find attorneys that maybe able to offer low-cost or even no-cost assistance. They will be able to relate your case to the laws and statutes as they exist in your state
