Q: Hello Eric,

I found your blog while searching work. First of all, I’d like to say how much I value your time and efforts in to provide helpful information for ex-offenders and felons looking for jobs. I have read through your blog and your advice has really given me hope in finding employment.

I was convicted of misdemeanor burglary. This happened more than a decade ago. I did not serve any time but served three years probation. Since then I received a bachelor’s degree, opened my own business, and plan to go back to for a Master’s degree.

I would like to work in a youth facility, specifically working with at-risk youth providing counseling, mentoring, and outreach. Notwithstanding, if a facility is licensed by the state, live-scan is a requirement.  I applied for and was granted an expungement. I recognize  the charge will still be on record. I actually had an interview for a facility and when asked about my criminal background,  I was honest, however, she could not hire me because of my conviction. I was informed that I could apply for an exemption.

My question/concern is that from researching  the process of receiving an exemption, I would have to have the facility send a letter/request to the Licensing board before I can fill out the appropriate application for exemption.  Is it common for any facility to honor this request?  How I interpret this is that this facility would have to go out of their way so they can hire you. My frustration is that any place is going to hire someone else that has a clean background over someone like myself. So I am wondering if you have had any experience with exemptions or clearances? Do you believe it’s possible for ex-offenders or felons to be employed in this field?

I’ve spent many months researching this subject. I really could not find much information relating to anyone else’s experience with this specific subject. It has been very demoralizing. I’d appreciate any insight you might have. Thank you for your time. Once again, thank you you for providing hope to people who have criminal records and want to re-enter society.

A: Hello Albert,

I suppose it could not hurt to apply for the exemption and the facility definitely would have to put some added effort into it. I want everybody to understand that expungement and sealing of records to not erase them. They simply are hidden from public view. The charge and subsequent conviction will always be visible to the court system, law enforcement and government agencies.

I know of ex-offenders and felons having similar jobs. The fact that you found out about such an exemption should give you hope if you really want this job.  I suggest to every ex-offender and felon looking for employment that they should apply for every job they believe they are qualified for.  Remember, finding a job is a numbers game.  The more jobs you apply for, the greater your chances of being hired.

If this should happen not to work out, an option is to contact your local United Way office. The United Way supports a wide array of social services.  They will be able to put you in contact with advocates and other organizations that provide assistance to ex-offenders and felons.  They also may be able to suggest agencies that provide the type of service that you want to get into.
