Hello! My name is Elizabeth and I saw where you gave a man a website about getting his record expunged in NC. Can you find one for me in MS? Here’s the situation: My dad was asked by his mother to drive drunk on Christmas Eve delivering a plate to an elderly man. He did it and was intoxicated. One month later, the first police officer’s cousin arrested him after PURCHASING but not consuming beer at a convenience store. The higher ups saw that it was a mess-up so they cut us loose- no fine, no time- just the conviction which, by itself was not a problem. Three years later, Dad was stopped in a road block. He tested negative on the breathalyzer but due to his priors the cop arrested him anyway (later fired in unrelated but crazy incident). Negative test “lost.” now no test results. We pleaded guilty because to lose would have meant 5 years in the federal penitentiary, Parchment. Now, every time we turn around it’s holding him back. Suggestions?

Mississippi law does allow expungement applications for misdemeanor DUI convictions. Unfortunately, this is only for first time offenders. Your dad has two convictions. My suggestion is to contact your local legal aid office. They may be able to give you more information on the process as it relates to expungement in Mississippi. They may also offer free or nearly free assistance if your dad qualifies for expungement.
