CAN EMPLOYERS REFUSE JOBS TO FELONS?Q: I have applied and had a interview with a major corporation for a service tech. They did call and offered me the job and said I can start after my background come back and they are an equal opportunity employer.

After getting my background check back can they call me and say were not giving you the job now?

 

Can employers refuse jobs to felons?

A: Were you totally honest on your application? The fact is an employer cannot legally refuse to hire an ex-offender or felon unless the conviction is directly related to the job for which they are applying. I have spoken with felons who have lied on applications and gotten jobs, only to lose them later when background checks were done. They did not lose their jobs because they were felons. They lost them because they were less than honest when applying.

I suggest to all ex-offenders and felons looking for jobs to get a copy of their records so they can be totally honest when applying.  You can get a copy of your record from your probation or parole officer.  You can also get a copy of your national record from the FBI:

Individuals can obtain a copy of their national criminal history record from the FBI by submitting a request to the address below. In order to receive a copy of your FBI record for personal, employment, or international work requirements the FBI requires the following:

1) A signed written request with a brief explanation for the request and your complete return mailing address.

2) Each request must contain two completed applicant fingerprint cards with all of the applicant’s personal information (name, date of birth, place of birth, etc.) and a current set of 10 rolled fingerprints and eight flat finger impressions. Fingerprints and impressions must be taken by a local law enforcement agency.

3) An $18.00 fee in U.S. currency by certified check or money order payable to the United States Treasury. This information is provided in compliance with the U.S. Freedom of Information Act.
