Can My Nephew Become a Police Officer with a Criminal Record?

Q: Dear Sir,

I am looking for advice or assistance for my nephew. He is currently 21 years old. When he was 17 he got into a car accident, he was drinking and totaled his car. No one was hurt. When the police officer arrived at the accident, my nephew, being a smart mouth (at the time) got into an argument with the policeman and spit on him. He was convicted of felony assault of the police man. He did no jail time but was on probation for about 2 years. He did fine in probation and had no further offenses. He cannot however find a job now. He graduated from high school, started college and is getting very good grades. He is now taking electrical classes. He really wants to be in law enforcement but has been told with his record that would be out of the question.

What can we (his family) do to help him? Can this ever be removed from his record. My heart breaks for him and I’m mad at him at the same time. Apparently he is going to pay for his 10 seconds of stupidity for the rest of his life. How can be get married and have a family, make a good living – if he cannot get a good job? I know I’m getting ahead of myself here. What do you think he should do?

This is an interesting situation. I have heard of ex-offenders becoming police officers. Many people apply to become law enforcement officers. Aside from basic qualifications, those who are in charge consider other factors. It is my strong opinion that your nephew will be considered as having no respect for the law. Clearing his record by expungement or other means will have little if any affect because his conviction will always be visible to the court system and law enforcement agencies.

Often an ex-offender needs legal assistance. It would be to his advantage to seek to have his record sealed or expunged as a means to afford himself other employment opportunities. You can get more information about the expungement process in the state of Illinois here:

He may also get free or low cost assistance with this at your local legal aid office.
